The mainline churches in South Africa are in turmoil internally as a result of divisions arising out of issues related to human sexuality. These issues have serious implications for these churches, church families within them, and the relationship of these churches with one another and with the state. There is little open space for debate as discussions are hampered by a variety of theological perspectives on the authority of scripture, some of which are fixed and absolutised. This is a matter (...) of justice for all those involved. This research article seeks to analyse the issues involved theologically and in terms of church polity, with a view of clarifying possibilities and options for a resolution of the distress and pain caused within and between members of the Christian family using the transnational context of the Uniting Presbyterian Church in Southern Africa as a case study. The concepts of critical solidarity and critical distance will be used to clarify relationships within the relevant contexts. This article is interdisciplinary and embraces the fields of Church History or Polity, Practical Theology, Missiology and Systematic Theology.CONTRIBUTION: This paper seeks to analyse issues of human sexuality within a South African Christian denomination with particular attention to the matter of justice. Since 1994 and the coming of democracy to South Africa there has been a concerted attempt to develop a coherent, unified educational system that will redress the inequities of the apartheid systems. Significant to this ongoing process is the field of higher education, where relevant legislation has been enacted in order to bring coherence and consistency to the education system in the public and private sectors. Significant issues have arisen with regard to the provision made by private religious educational institutions, (...) especially those who have experienced difficulties in being accredited by statutory bodies. This paper seeks to explore these issues and suggest ways forward that are appropriate within an emerging unitary system of education that is fit for purpose in Africa and particularly South Africa, taking as a case study the formation of the Association of Christian Religious Practitioners. The year 2022 marks a century since the death of Reverend John Knox Bokwe, a minister of the United Free Church of Scotland Mission in South Africa. Although little known, Bokwe was an important member of the emerging African intellectual elite towards the end of the 19th century. He demonstrated the creative tension that arises when two cultures encounter each other as he confronted and made sense of the historical meaning of modernity. He emphasised the value of his traditional culture (...) in a context where western culture was making a significant transforming impact on African life, which produced a creative tension throughout his working life in various contexts. This paper analyses his particular contribution as an active committed Christian through a number of overlapping lenses – his life in clerical work, journalism, literature, theology, education, music and his involvement in social and political issues and ministry. In all this he operated with a holistic vision. The paper offers an assessment of his life’s work using a combination of primary and secondary sources. Contribution: This article adds to the growing body of work that is derived from studies on the emergence of indigenous leadership in South Africa by looking at the life, work and Christian witness of Rev John Knox Bokwe from the perspective of the creative tension that he experienced and navigated in the varied professional and vocational perspectives he engaged in during his life. His friend replied, "Well, obviously because it just looks as though the Sun is going round the Earth." Wittgenstein replied, "Well, what would it have looked like if it had looked as though the Earth was rotating?” What would it have looked like if we looked at all (...) sciences from the viewpoint of Wittgenstein’s philosophy? Wittgenstein is undoubtedly one of the most influential philosophers of the twentieth century. His complex body of work has been analysed by numerous scholars, from mathematicians and physicists, to philosophers, linguists, and beyond. This volume brings together some of his central perspectives as applied to the modern sciences and studies the influence they may have on the thought processes underlying science and on the world view it engenders. The contributions stem from leading scholars in philosophy, mathematics, physics, economics, psychology and human sciences; all of them have written in an accessible style that demands little specialist knowledge, whilst clearly portraying and discussing the deep issues at hand. A detailed theoretical analysis is presented of what five utility representations – subjective expected utility (SEU), rank-dependent (cumulative or Choquet) utility (RDU), gains decomposition utility (GDU), rank weighted utility (RWU), and a configural-weight model (TAX) that we show to be equivalent to RWU – say about a series of independence properties, many of which were suggested by M. H. Birnbaum and his coauthors. The goal is to clarify what implications to draw about the descriptive aspects of the representations from data (...) concerning these properties. The upshot is a sharp rejection of SEU and RDU and no clear choice between GDU and TAX, but a list of 8 properties is given that should receive more attention to discriminate between the latter two models. Tiyo Soga, the first black minister ordained in Scotland by the United Presbyterian Church of Scotland in 1856, was, by any standards, a conflicted character. He stood both in and between two worlds and suffered from the vulnerability that emerged from his dual allegiances. Yet he made a significant contribution to the mission history of South Africa, particularly through his early influence on the development of black consciousness and black nationalism, which were to make significant contributions to black thinking in (...) the 20th century. One aspect of the utility of gambling may evidence itself in failures of idempotence, i.e., when all chance outcomes give rise to the same consequence the `gamble' may not be indifferent to its common consequence. Under the assumption of segregation, such gambles can be expressed as the joint receipt of the common consequence and what we call `an element of chance', namely, the same gamble with the common consequence replaced by the status quo. Generalizing, any gamble is indifferent to the (...) joint receipt of its element of chance and a certain consequence, which is called the `kernel equivalent' of the gamble. Under idempotence, the kernel equivalent equals the certainty equivalent. Conditions are reported (Theorem 4) that are sufficient for the kernel equivalents to have the kind of utility representation first discussed by Luce and Fishburn (1991), including being idempotent. This utility representation of the kernel equivalents together with the derived form of utility over joint receipts yields a utility representation of the original structure. While the role of comparative law in the courts was previously only an exception, foreign sources are now increasingly becoming a source of law in regular use in supreme and constitutional courts. There is considerable variation between the practices of courts and the role of comparative law, and methods remain controversial. In the US, the issue has been one of intense public debate and it is still one of the major dividing issues in the discussion about the role of the (...) courts. Contributing to the existing discussion of the use of comparative law in the courts, this book provides an inclusive, coherent, and practical analysis of the relevant law and jurisprudence in comparative law in the courts. It examines the consequences for court procedures and the form of judgments, as well as how foreign sources are drawn upon in private international law, European law, administrative law, and constitutional law as well as before general courts. Affect Theory, Genre, and the Example of Tragedy employs Silvan Tomkins' Affect-Script theory of human psychology to explore the largely unacknowledged emotions of disgust and shame in tragedy. The book begins with an overview of Tomkins' relationship to both traditional psychoanalysis and theories of human motivation and emotion, before considering tragedy via case studies of Oedipus, Hamlet, and Death of a Salesman. Aligning Affect-Script theory with literary genre studies, this text explores what motivates fictional characters within the closed conditions of (...) their imagined worlds and how we as an audience relate to and understand fictional characters as motivated humans. Vuyani Vellem was an outstanding Black Theologian of Liberation (BTL), who was approaching the zenith of his career when he died at the age of 50 years in 2019. This paper begins with a personal memoir to Prof. Vellem and a recognition that there is a lacuna in BTL relative to human sexuality issues. The contemporary global context of the human sexuality debate is discussed before the task of BTL in Vellem’s thinking is outlined. This is followed by an examination (...) of the situation in Africa and South Africa. Following this, the article proceeds to introduce the issue of human sexuality as a potential field of research in BTL and argues that the subject of human sexuality in the black community is a valid and appropriate topic for study and research by BTL. Contribution: This article raises pertinent issues regarding the development of a Black Theology of Liberation (BTL) which includes a proposal for the inclusion of LGBTI+ issues. The only constant in theological education is change, despite brave attempts to hold the tide back in some quarters. Yet, Western-based theological education remains the norm globally. The Faculty of Theology at the University of Pretoria exemplifies this norm despite its commitment to Africanisation. This article will consider transformation through the lens of the leadership of Prof. Johan Buitendag, who has led the transformation initiative from his own shared leadership perspective as dean since 2010. Change in the faculty will be (...) analysed through analysis of the faculty plans, with particular reference to teaching, learning and research. Consideration will be given to a more radical proposal for future transformation under the initiative of Africanisation. (shrink)

The paper introduces a concept of a ‘negotiated space’ to describe university researchers’ attempts to balance pragmatically, continually and dynamically over time, their own agency and autonomy in the selection of research topics and pursuit of scientific research to filter out the explicit steering and tacit signals of external research funding agencies and university strategies and policies. We develop this concept to explore the degree of autonomy researchers in fact have in this process and draw on semi-structured interview material with (...) research group leaders in Finland and the UK, in the former in seven research fields, in the latter in two fields. First, the analysis reveals that topic selection is strongly filtered by the intra-scientific factors. In topic selection researchers have more leeway, a broader negotiated space than in research content, that is, in the ways in which they pursue their research, which are more affected by funding opportunities and other contextual matters. Second, the ways which affect researchers’ agency include individual- and more aggregate-level acts and factors: at the individual level, researchers resort to different strategies to create a negotiated space, but at the more aggregate level field-specific factors play a role. In fields with multiple funding opportunities, which we call ‘shopping mall’ fields, researchers can have a broader negotiated space than in fields where funding is more based on ‘lottery’. In the latter, the researchers’ negotiated space is narrow and contingent on the outcome of the funders’ decisions. (shrink)

Variant Creutzfeldt–Jakob disease is a fatal, transmissible, neurodegenerative disorder for which there is currently no effective treatment. vCJD arose from the zoonotic spread of bovine spongiform encephalopathy. There is now compelling evidence for human to human transmission through blood transfusions from presymptomatic carriers and experts are warning that the real epidemic may be yet to come. Imperatives exist for the development of reliable, non-invasive presymptomatic diagnostic tests. Research into such tests is well advanced. In this article the ethical implications of (...) the availability of these tests are elaborated and comparisons drawn with predictive genetic testing for Huntington’s disease and screening for HIV. Paramount to considerations is the issue of whom to test, weighing up respect for personal autonomy against obligations to benefit and protect society. A paradigm is proposed similar to that used for HIV screening but with unique features: compulsory testing of all blood/organ donors and individuals undergoing surgery or invasive procedures who have a significant risk of disease transmission. Predictive genetic testing is now routinely offered to asymptomatic adults at risk for genetic disease. However, testing of minors at risk for adult-onset conditions, where no treatment or preventive intervention exists, has evoked greater controversy and inspired a debate spanning two decades. This review aims to provide a detailed longitudinal analysis and concludes by examining the debate's current status and prospects for the future. Fifty-three relevant theoretical papers published between 1990 and December 2010 were identified, and interpretative content analysis was (...) employed to catalogue discrete arguments within these papers. Novel conclusions were drawn from this review. While the debate's first voices were raised in opposition of testing and their arguments have retained currency over many years, arguments in favour of testing, which appeared sporadically at first, have gained momentum more recently. Most arguments on both sides are testable empirical claims, so far untested, rather than abstract ethical or philosophical positions. The dispute, therein, lies not so much in whether minors should be permitted to access predictive genetic testing but whether these empirical claims on the relative benefits or harms of testing should be assessed. This review article enters into discussion with Peter Kallaway, in his work, The Changing Face of Colonial Education in Africa: Education, Science and Development, who raises serious issues related to the historical development of South Africa’s education during the first half of the 19th century and its current situation and future prospects in the broader context of African education. Education is a dynamic process that encompasses the formal and informal sectors historically. In South Africa, the informal was the norm for (...) centuries before the intrusion of Western influences and formal education needs to work alongside the informal processes based in the home, the church and the community. Formal education is a product of the West and came to occupy the determinative place in the period covered by this book, while the informal sector was relegated to a subservient role despite its inherent value. Kallaway discusses these issues by analysing the contributions of external factors such as the International Missionary Council in the religious sphere and the New Education Fellowship and the British colonial service in the secular sphere. These played a significant role in the movement from ‘culture-bound’ to a universalised approach to education in Africa and particularly South Africa. Alongside this, the role of mission education is discussed as a source of tension with external forces and as a significant contributor to the development of education not restricted to the religious domain. Mission education emerges as an innovative force in educational development as a part of the international movement within the context of an emerging ‘development’ paradigm. The external and internal forces and the cultural and universalising are not necessarily in opposition to one another but often in conversation with and in tension with one another’s assumptions. Kallaway undertakes two case studies of South African scholars, Donald M’Timkulu and SEK Mqhayi in order to refine his analysis. It has been alleged with truth that the trader and settler followed the missionary, who was the agent of European imperialism, working hand in hand with the colonial powers for the subjugation of the black people and the territorial extension of the imperialist power. This view has been challenged by Brian Stanley who cautions against a too simplistic interpretation of the relationship between colonisation and Christianisation reached through ideological means rather than intensive historical research. He concludes that the process first appears more complex and seeks to avoid generalisations. This provides an appropriate starting point for this review article, which attempts to go beyond the historical by raising contemporary issues related to the concept of Africanisation.Contribution: This article contributes to the ongoing debate regarding developments in education in a colonial context from a historical perspective. This is relevant to current debates and challenges to the ongoing effects of colonisation in education in a democratic society and the prospect of an epistemological shift towards the Africanisation of education.
